Terms of Service

1. Agreement to Terms

By accessing or using SegmentKit ("the SDK"), provided by Wei Chen ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the SDK.

2. Description of Service

SegmentKit is a commercial software development kit for real-time video object segmentation on iOS devices. The SDK is distributed as a pre-compiled binary (XCFramework) via Swift Package Manager.

3. License

Subject to your compliance with these Terms and a valid license key, we grant you a limited, non-exclusive, non-transferable, revocable license to use the SDK in your applications. The license is tied to the plan you subscribe to (Free Trial, Indie, Pro, or Enterprise).

You may not:

• Reverse engineer, decompile, or disassemble the SDK
• Redistribute the SDK binary outside your application
• Remove, alter, or circumvent any license validation mechanisms
• Sublicense or transfer your license to a third party
• Use the SDK after your license has expired without renewal

4. Free Trial

We offer a 7-day free trial with full access to all SDK features. No credit card is required. After the trial period, you must subscribe to a paid plan to continue using the SDK. Each email address is limited to one trial license.

5. Subscriptions and Payment

Paid plans are billed monthly through our payment provider, Paddle.com Market Limited ("Paddle"), who acts as the Merchant of Record. Paddle handles all billing, tax collection, invoicing, and payment processing. By subscribing, you also agree to Paddle's Terms of Service.

6. Intellectual Property

The SDK, including its code, documentation, and related materials, is the intellectual property of Wei Chen. The underlying EdgeTAM model architecture is open source under the MIT License by Meta Research; however, the SegmentKit SDK as a whole (including its optimizations, Metal pipeline, and license system) is proprietary.

7. Disclaimer of Warranties

THE SDK IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SDK WILL BE UNINTERRUPTED OR ERROR-FREE.

8. Limitation of Liability

IN NO EVENT SHALL TUSOON WELLNESS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Termination

We may terminate or suspend your license at any time if you breach these Terms. Upon termination, you must cease all use of the SDK and destroy any copies in your possession. You may cancel your subscription at any time through Paddle.

10. Changes to Terms

We reserve the right to update these Terms at any time. We will notify subscribers of material changes via email. Continued use of the SDK after changes constitutes acceptance of the new Terms.
